They argue that unlike physical goods, digital transactions for games do not confer traditional ownership, as access can be revoked. Sony's defense relies on its End User License Agreement (EULA), which explicitly states that digital content is licensed, not sold. The lawsuit also references a California law requiring clear and conspicuous disclosure when digital goods are sold under terms implying unrestricted ownership, but actually only grant a license. Amidst this legal challenge and its move away from physical game production by 2028, Sony recently distributed emails detailing its terms and agreements, possibly as a proactive measure to address user understanding and mitigate future legal disputes.
