Washington D.C. Implements Nation's Strictest Anti-Scalping Ticket Law
Washington, D.C. has established a groundbreaking regulatory framework for concert ticket sales, positioning itself with the nation's most stringent anti-scalping measures. The newly enacted RESALE Act, passed unanimously by the District of Columbia Council, introduces significant changes to how tickets are bought and sold in the secondary market.
The core of this legislation is a critical cap on resale prices, limiting them to just 10% above the original face value of the ticket. This aims to dramatically curb the inflated prices often seen on platforms like StubHub and Vivid Seats. Additionally, the act bans the practice of selling speculative tickets, where brokers list tickets they do not yet possess, a move designed to enhance transparency and prevent deceptive sales. Furthermore, individuals reselling more than 50 concert tickets annually will now be required to register with the District, ensuring greater accountability within the secondary market.
This pioneering approach from Washington, D.C., a major hub for touring artists and home to prominent venues, is expected to influence other markets. Stephen Parker, Executive Director of the National Independent Venue Association, praised the RESALE Act as a national benchmark for consumer protection, highlighting its focus on fan interests and support for independent venues. Councilmember Charles Allen emphasized the need to combat exploitative practices by large ticketing entities, noting a recent investigation into StubHub's operations. While D.C.'s law is the most assertive to date, other states like Vermont have also implemented resale caps, and California and New York are considering similar legislation, indicating a growing nationwide movement toward fairer ticket pricing.
