The FTX bankruptcy saga is reaching its ultimate phase, with the core lesson for all involved being the absolute necessity of timely form submission. As the proceedings draw to a close, a solitary dispute is poised for resolution on August 19, underscoring the critical impact of missed deadlines on claimant recoveries.

FTX Bankruptcy: A Lone Battle for Missed Deadlines

On Monday, the court agenda revealed a singular customer appeal awaiting Chief Judge Karen B. Owens' decision. Daizhuo Chen, a claimant, is seeking a second opportunity to rectify a missed verification deadline. Chen submitted his motion on March 27, petitioning Judge Owens to reconsider her initial refusal to allow him to complete his verification process belatedly. His arguments invoke Federal Rules of Civil Procedure 59(e) and 60(b)(2), which permit judicial decisions to be reopened upon the emergence of new evidence. However, the court has yet to acknowledge the existence of such evidence in this particular case.

The established timeline for FTX claims was stringent and explicitly communicated. Customers were instructed to initiate their verification by March 1, 2025, and finalize the process by June 1, 2025. Both deadlines concluded at precisely 4 p.m. ET. The FTX Recovery Trust, the entity responsible for managing the estate's liquidation, reasserted its objection to Chen's request on July 16, consistent with its stance on similar prior applications.

Chen's situation is not unique. D1 Ventures, for instance, has been pursuing the recovery of $251,000 in USDC and USDT since December 2022, facing obstacles due to an uncompleted verification process. This particular motion, along with two other related suits, has been further postponed, indicating ongoing complexities in these cases. In parallel, Ernst & Young has filed its final fee application, and legal counsel will be submitting orders without oral arguments, signaling the imminent conclusion of the estate's administration.

The meticulous verification process serves as the gateway to receiving payments. Claimants were mandated to successfully complete know-your-customer (KYC) checks, submit tax documentation, and onboard with designated platforms such as BitGo, Kraken, or Payoneer. Any omission in these steps directly led to the forfeiture of funds. The Trust has previously stated that hundreds of thousands of customer claims have already been rejected due to failures in these crucial verification procedures.

A stark contrast exists between those who completed the necessary paperwork and those who did not. Creditors who successfully navigated the verification process have not only recovered their full claims, but several categories have received even more. This includes a 120% recovery for convenience claims, 100% for U.S. customer claims, 100% for general unsecured claims, and 96% for Dotcom customer claims.

These figures encompass the fourth round of repayments, which distributed approximately $2.2 billion by March 31. A subsequent, smaller distribution of around $900 million occurred on July 31. Funds continue to be held in reserve for contested claims, with the Trust proposing a reduction of this reserve by $600 million, bringing it down from $2.4 billion to $1.8 billion.

Therefore, Judge Owens' upcoming ruling will have implications far beyond Chen's individual case, offering potential insights and avenues for all claimants still grappling with unfulfilled paperwork. Notably, Sam Bankman-Fried, the disgraced founder, no longer plays any role in these proceedings. His conviction and 25-year sentence were affirmed in June, and his appeal at the Second Circuit concluded in August.

The hearing is scheduled to commence at 9:30 a.m. ET on Wednesday via Zoom, with Judge Owens expected to deliver her decision from the bench. Her verdict will provide a definitive answer to all late filers regarding the remaining opportunities for their claims.

This case serves as a poignant reminder of the intricate and often unforgiving nature of bankruptcy proceedings, particularly within the nascent and rapidly evolving cryptocurrency landscape. The emphasis on strict adherence to administrative deadlines and verification protocols underscores the challenges faced by both claimants and administrators in unwinding complex financial entities.
