U.S. District Judge Paul Engelmayer issued a ruling on June 4, highlighting that the product's packaging, which features a giraffe and ruler-like markings, could cause consumers to interpret the terms "grow" as an increase in height and "gain" as an increase in weight. This interpretation, according to the judge, merits further legal examination, leading to the continuation of the lawsuit against Abbott Laboratories.

In a comprehensive 75-page decision, Judge Engelmayer also pointed out that jurors could conclude the company's advertisements bolstered this potentially misleading message. He specifically cited a commercial depicting a young boy comparing his stature to that of his taller peers, suggesting that such imagery reinforces the notion of height promotion.

Abbott Laboratories maintains that its product labeling is accurate and supported by scientific evidence, asserting that PediaSure effectively supports children's overall growth and development. However, plaintiff Joanne Noriega recounted that her grandson, despite daily consumption of PediaSure for a year, did not grow taller but instead became overweight. Her legal representative, James Denlea, expressed satisfaction with the court's decision to allow the case to advance.
